I would like to know if entry clearance is now possiable under zambrano . the person who wishes to apply is the mother of 2 british children.She was tricked by her former husband to go to her home country and on arrival subjected to violence and her passport and childrens passport taken off her.She was led to believe that she had PR in uk but this was confirmed as incorrect.She has spent 5 years in her home country and 2 visit visas to uk have been refused.Her former husband also lives in that country but has no contact with children or any contact through the courts or otherwise.She plans to marry very soon also.Can she an her new partner make application under zambrano? The children want to return to uk but cannot because their mother an step father cannnot come to the uk.Also if the real father is contacted this will be risk to her and the children. Does anyone know what can be done in these circumstances?

I suggest you contact a lawyer on her behalf. I think entry clearance is now possible for Zambrano applicants but am not sure about stepfather as dependent applicants; bear in mind that Home office's initial scope for Zambrano is for single parents of British children.

Thanks for your input.Is there any specfic form to be used for out of country family permit under zambrano.Also what sort of evidence would she need to submit with her application?Do you think they will ask where the childrens real father is residing?
