Ext Vs ILR (Time spent outside country).

Post by raviktiwari » Fri Nov 16, 2012 1:19 am

Hello Everybody,

After helping few people in the forum for last 5 years it seems that now I need some help/suggestions, so here I am. :-)

Before I ask my questions, I would like to give the background of my case:

My first visa stamping was valid from 13th Feb 2008 to 13th Feb 2010
We came here on 9th April 2008
Got the Visa extended - Valid from 13th Feb 2010 to 13th Feb 2013

Out of country:
Late coming to UK: 55 days
Trip to Europe (Office work): around 50 Days
Trip to India (Official work): Around 22 Days
Trip to India (Holidays): 42 Days

So overall time out of country is around 169, out of which personal is: 55 days (late coming) and 42 days (Holidays) in last 5 years.

I have been planning to take an extension from August onwards, but few friends in this forum (knowing my timeline) suggested not to worry and apply for ILR directly. So I changed my plan and thought of applying for the ILR using personal appointment and if it is rejected for whatever reason (timeline). I will have enough time to apply for extension via post.

Now my concern is:

Right now, I am not getting any dates anywhere and if this is how this site works and I end up having no personal appointment in time, I will have to apply for my ILR thru post and if for some reason it gets rejected, I won’t even have the time to even go for the extension.

So what do you guys suggest? What should I do?
Am I safe in applying for ILR via post?
I have no issues whatsoever with my paper and/or points. But is my time spent out of country good and safe enough?
Anything else that I should be aware of?

Looking forward for your help/suggestions/feedback.

Thanks and Regards,
-Ravi

1. Your 'late coming' 55 days is not part of your absences.

2. You need to tell us your visa history - what was the initial visa, what is your current visa

I came on HSMP (2 years) and got extended under Tier-1 (3 years) and that is what I currently have.

So now after spending 5 years (by Feb 2013), I want to apply for ILR.

Thanks and Regards,
- Ravi
