Is Statutory Maternity Pay a benefit or not..Please advice

Dear All

Me and my wife are applying together for ILR (same day service) early next year.

My wife worked for a company for six months and after that she went on maternity leave for a year(got paid SMP for 9 months and then 3 months unpaid). because of my little one she did nt return to work and resigned from her job.

Now my query is Statutory Maternity Pay is categorised as a benefit or not. Does it effect my ILR application ?

Please advice....

SMP is not classed as benefit in this case.

A quick online search for 'ukba benefits' shows you the link.

yes SMP will not efffect ur ILR application and its not considered under benefits which effect ur ILR eligibility ...

My wife has a Tier-2 PBS dependent Visa and with condition of no recourse to Public funds.
I know that Statutory Maternity pay(SMP) paid by Employer does not breach her condition but I have a confusion about Maternity Allowance paid by Job Centre Plus because My wife'a employer told her that she
did not work long enough to be eligible for SMP but she is eligible to claim Maternity allowance paid by job centre Plus.

Will anybody advice me whether my wife should claim Maternity allowance or not?
If she claim maternity allowance then whether its breach of her Visa condition or not?
And any impact on her future Visa extensions and Indefinite Leave to Remain(ILR)?
