Got an extension for only 2 years (was expecting 3)

Post by azorpheunt » Wed Dec 12, 2012 10:36 pm

Hi,

My Tier 1 General VISA is valid from January 2011 to January 2013.

I just went in for my first extension and received the BRP today. I was very surprised to find out that that I had got only two years extension. I was expecting three years. Am I mistaken ?

Please reply ASAP. This is driving me nuts :(

Regards,
Ash.

245CB. Period and conditions of grant

(a) Leave to remain will be granted for a period of 2 years, to an applicant who has, or was last granted, leave as a Tier 1 (General) Migrant under the Rules in place before 6 April 2010.

My apologies. I corrected the date in my post above.

My first VISA was from January 2011 to January 2013 (i.e. 2 years). Thus according to :

245CB. Period and conditions of grant
(b) in all other cases, leave to remain will be granted for a period of 3 years.

Should I not have gotten an additional 3 years of extension ?

Depends on when you applied initially.

If your initial Tier 1 general application is after 6 April 2010 then you should get 3 yrs in your first extension.

I think its an error and you can contact UKBA.

you might contact the below email id-

ukbacustomercomplaints@homeoffice.gsi.gov.uk, PEOComplaints@homeoffice.gsi.gov.uk
