i read your guidelines ragarding above visa.i need clarification regarding 3 months HM revenue registration period.

guidelin saying.. condidate were, on a date no earlier than three months prior to the date of
application,
(1) registered with HM revenue and Customs as self-employed,

in other paragraph your guidelines saying, You must have been registered as self-employed or a director of a business within the
last 3 months before submitting your application as a Tier 1 (Entrepreneur).

i am still confused about 3 months rule

can you please clarify that candidate should apply visa after 3 months after registering as self employ and business or do the condidate should apply visa with in 3 months or before ending three months.


Second question

guidelines saying that candidate should only work on level 4 business so my question is that. c after getting initially 3 years Entrepreneur visa , can conditate start other type of busness in order to spend £5000

The guidance was recently overhauled to eliminate a great deal of confusion (myself included) about the three month threshold. It is not limited to registrations that have taken place only in the previous 3 months. It is, in fact, a requirement to have remained registered during the previous three months. So,you must supply the evidence that you have been registered as a director, or as a self-employed worker, within the three months before you apply. If you were registered for self-employment or as a director earlier than three months before you apply you should provide evidence that you remained registered during the three month period before the application.

You must have been registered as self-employed or a director of a business within the last 3 months before submitting your application as a Tier 1 (Entrepreneur). If you were registered earlier than this you will still need to provide evidence that you were registered in this period

I am an accountant and roughly 3 months have been passed since ivregistered sole proprieter.. I am waitng for some documents from my professional body and for my office building, might b its take further 3 weeks then i.ll apply visa but i am confused about 3 months rule because it would be more than 3 months since registration ad self emply when i apply visa but ukba reqire apply with in 3 months. It wud be great if you tell me can i still eligible to aoply After 4 months

He spent so much time in explaining so comprehensively but you are still asking if you are eligible?

Hi , I registered with hmrc as self employed -dated 14 nov 2012. ON page 39 (G19) . Which box i have to check , i didn't receive any bill . only the self assesment letter . after three month have to pay tax.
Please advise regarding , how i have to pay bill , any link.....

Tricky situation, bill is issued every six month in April and October. If you recently got register then you wont have any of three given below:

1. A National Insurance (NI) bill from the HMRC to you, dated, and from the billing period immediately preceding the application
2. Your current bank statement showing the direct debit payment of National Insurance
3. A Small Earnings Exception certificate from the latest return date

*If you have recently registered and have not yet paid a contribution......

But this information is not reflect on form on 13 dec 2012.... Page 27- (g19)

Please advise ,if anybody have any solution for that....

I've been wondering about this as well. Is this a mistake in the form?
Also, how long does it take to receive a Certificate of Small Earnings or to set up a direct debit?

Yes, you are correct... form and policy guidance seems to contradict each other. In the form it is written that you musts provide one of following three:

1. 6 month bill
2. Small earnings exception certificate
3. Bank statement confirming direct debit to HMRC

However all these things are available at least 40-60 days after you get registered.. So if you recently got registered you have nothing in your hand from above 3 to show that you meet the requirement.

However in the policy guidance it states that you can even provide welcome letter from HMRC as proof of registration.. So no clear answer is present.
