Need help on Partner Visa

Hi

My wife has joined me in May 2011 under the tier 2 dependent visa.
We had extended our tier 2 visa in Sep 2012 which is valid till OCT 2014.

Recently I got my ILR under tier 2 ICT category.

I am planning to apply for FLR (M) for my wife in Jan 2013 and ILR in MAY 2013.
Or
Wait till May 2013 and then apply for ILR in May 2013 since her current tier 2 dependent visa is valid till 2014.



But I have noticed one strange sentence on UKBA site:

if you look at the second para on this page they have mentioned "If you had not applied for a visa under this category by that date".
What they meant by "This category" ? Are they saying FLR(M) ?

Can I go ahead with my plans ?

Yes, that refers to people that applied as the spouse or partner of a BC or person who is settled (already has ILR) - so it would be VAF4A or FLR(M)

I am sure that if your wife switches to FLR(M), then she will have to wait 5 years in this category before she is eligible for ILR. From various posts on the PBS dependents, I am sure she can stay in that category and apply for ILR once she qualifies with 2 years residence. Maybe a senior member or guru can confirm or provide the link.

One more point : We have last extended our Tier 2 Visa in September 2012. In Dec 2012 I got my ILR.

so what is your question?

Would it not be far cheaper to apply for her ILR when she qualifies as a T2 dependent rather than switch to FLR(M)??

Yes, I can wait till May 2013.

Can I switch my Job/Employer before her qualifying period ? Or do I need to stick with current employer only ?

I am pretty sure that as you are now on ILR, you can change jobs. But maybe a senior member could confirm.

According to sushdmehta, I can apply for FLR(M) in Jan 2013 and then apply for SET(M) in May 2013.
