tier 4 to tier 1 entrepreneur

tier 4 to tier 1 entrepreneur

Hi Experts!!
Just wanted to find out if a tier 4 student is able to switch to tier 1 entrepreneur visa.I am a tier 4 student and i have 50000 pound in my account.will I be able to switch my visa to entrepreneur as im not clear of the new rules that have come into effect from 13 december 2012.I would be grateful if someone will be able to illustrate this.As of today i have 6.5 in ielts and 50000 in my account and currently studying acca and have completed 11 papers out of 14.thank you.

Yes, you can switch into Tier 1 (Ent), with 200,000.

But as far as I'm aware that rule has been changed from 13 December 2012!!!!!!!

Hi

After 13th December 2012 you can not switch to tier 1 ENt from Tier 4 unless you £50K from a capital venture firm or other sources mention in Guidline by UKBA, if you do,nt have funding then you have to leave UK and apply from outside the UK with £200K and you will be required B1 level of english.

The OP clearly indicated that he had 50K in his bank account (so not VC or GVT seed funding). He can't apply for Tier 1 (Ent) with that sum, now or in the past.

Please Read again and correct me if i am wrong.

Attributes for Tier 1 (Entrepreneur) Migrants
35. An applicant applying for entry clearance, leave to remain or indefinite leave to remain as a Tier 1 (Entrepreneur) Migrant must score 75 points for attributes.

36. Subject to paragraph 37, available points for applications for entry clearance or leave to remain are shown in Table 4.

36A. An applicant who is applying for leave to remain and has, or was last granted, entry clearance, leave to enter or leave to remain as:

(i) a Tier 4 Migrant,
(ii) a Student,
(iii) a Student Nurse,
(iv) a Student Re-sitting an Examination, or
(v) a Student Writing Up a Thesis,

will only be awarded points under the provisions in (b) in Table 4.

Table 4

(a) The applicant has access to not less than £200,000, or

(b) The applicant has access to not less than £50,000 from:

(i) one or more registered venture capitalist firms regulated by the Financial Services Authority,

(ii) one or more UK Entrepreneurial seed funding competitions which is listed as endorsed on the UK Trade & Investment website, or

(iii) one or more UK Government Departments, or Devolved Government Departments in Scotland, Wales or Northern Ireland, and made available by the Department(s) for the specific purpose of establishing or expanding a UK business,

21.You are allowed to make an initial application in the UK (including switching from one
immigration category to another) if you are here with permission to stay as:
• a highly skilled migrant; • a Tier 1 (General) migrant;
• a Tier 1 (Entrepreneur) migrant; • a Tier 1 (Investor) migrant;
• a Tier 1 (Post-Study Work) migrant; • a Tier 1 (Graduate Entrepreneur)
migrant
• a Businessperson; • an Innovator;
• a Work Permit holder; • a Writer, Composer or Artist;
• a Self employed Lawyer; • a participant in the International
Graduates Scheme (or its predecessor, the
Science & Engineering Graduate Scheme);
• an Investor; • a participant in the Fresh Talent: Working in
Scotland Scheme;
• a Tier 2 migrant; • a Prospective Entrepreneur.
22.If you are in the UK with permission to stay as:
• a Tier 4 migrant; • a Student nurse;
• a Student; • a Student writing up a thesis;
• a Student re-sitting an examination; • a Postgraduate Doctor or Dentist;
you are allowed to make an initial application in the UK (including switching from one immigration
category to another) only if you have specific types of funding. You must have access to
£50,000 or more from:
i) one or more registered venture capital firms regulated by the Financial Services
Authority;
ii) one or more UK entrepreneurial seed funding competitions which is listed as endorsed
on the UK Trade & Investment website; or
iii) one or more UK Government Departments or Devolved Government Departments in

(This is also referred to as a section b funding in this document.) Students without this type of
funding are not permitted to switch into the Entrepreneur category in the UK

But how he can switch to Tier 1 even if he have 200000?
He need an Entry Clearance.

Typo. I meant apply. Yes, it would have to be outside the UK. The original question has been sidetracked somewhat in that the OP has only 50K and is not eligible for Tier 1 (Ent) with that money.
