Tier 1 dependent to ILR dependent

Post by abhinavsid » Sat Jan 05, 2013 12:12 pm

Hi Gurus,

I have a query. I have not found an answer to my question yet.

My wife has been in UK for last 5 years and is applying for ILR. Her recent Tier 1 expires on Feb 2013.

We got married in Oct 2012 and I did my Tier 1 dependent visa and came to country on 27th December 2012.

Now my big question is, if I need to apply FLR(M) or PBS dependent.
http://www.ukba.homeoffice.gov.uk/visas ... you-apply/

This link has got me confused. It says Partners or families of people whose recent most visa was Point Based should apply extension under PBS category and not under FLR category.

However most lawyers I have spoken to say I should do my visa under FLR category. Please help!!!!

Existing rules take precedence over anyone's interpretation of those rules.
Please do not send me PM if I haven't sent you one yet.
