ILR - Baby in India

Hello experts,

We are going for ILR next month, expecting to get our baby this month before going for ILR.

She was born in UK and is 2 years old, but stayed out of UK for most of the time.

my queries are:
1. Is it possible to apply for ILR for baby from outside UK.

OR

2. Any issues, if we DO NOT include her in out SET O form and directly apply for citizenship once she is in UK.


3. Will there be any problem for her entry into UK as she is on Tier- 1 dependant visa, after we go for ILR.

Please advise.

Hi Vijji,

If the Baby born in UK, as you said let the baby comes to UK before you apply ILR, but don't include baby in your ILR application. You and your partner get ILR first.

Then your baby eligible to register as British Citizen straightaway. No need of ILR for your baby.

My concern was if she is not included in ILR and we got for citizenship directly for baby, will there be any other issues as she is OUT of UK for more than 1/ONE year.

No issues, as UK residency is not a requirement of her entitlement.
