Query regarding ILR

Hi All,

I initially got my HSMP during 25-MAY-2008 and i entered UK on 28-JUN-2008. Currently i am having my Tier1 General visa up to May 25 2013. I am planning to apply for ILR between May 1st till May 15 2013 before my visa expires on (25th May 2013). But my issue here is, since i came to UK one month + 3 days after i got my visa in 2008, am i still eligible for ILR? as i am completing only 4 years 10 months and xx days. Or do i need to go for one more extension??

Initial HSMP 25-May-08
Date entered UK 28-Jun-08

I had a look at the application form SET(O) and it asks for these details in Immigration History

6.1 When did the main applicant first enter the UK ?? 28 Jun 2008

7.11 How long have you lived in the UK? Years & Months

My answer for 7.11 will be 4 years and 10 months

Will i be eligible for ILR if i complete just 4 years and 10 months?

Could anyone answer my query please?

One more additional information i wanted to provide is

Period of absence in each years

Year Date Date absence period
Y1 5/5/2013 5/4/2012 25
Y2 5/5/2012 5/4/2011 45
Y3 5/5/2011 5/4/2010 40
Y4 5/5/2010 5/4/2009 35
Y5 5/5/2009 6/28/2008 37

Absence period total is 182 days and if i exclude the 37 days in 2008(as i came only in Jun 28th 2008 after a gap of 37 days after my visa) it will be less than 180 days.

Am i still eligible?

Hi All,

Good Afternoon.

To add on with my previous query, its regarding my wife's ILR Eligibility. She entered UK with Tier1-dependent visa on 4th July 2011. Since she hasn't completed 2 years continuously i believe she is not eligible for ILR. But she had visited UK previously with Work-permit during 2008(March till November) and stayed here continuously for the whole period.

Can she consider that WP period and include with the current period so that she will be eligible for applying ILR with me or does she need to go with Tier1 PBS dependent first and then wait until she completes 2 years continously( Till July 2013) and then apply for ILR?

Let me know your thoughts.
