Appealing and receing benefits?

Post by LoveMyBaby786 » Tue Feb 12, 2013 9:42 pm

Im on maternity leave which ends in march. Basically as i cant afford anyone to look after my baby i decided to be a stay at home mother.
What i want to ask is i have had to appeal my husbands spousr visa, if i claim income support will this affect our application? I genuinely thought my husband would be here by now so he could work while i look after our child but due to his visa refusal this ont be happening.
So would me getting income support affect the appeal?[/code]

Did you apply before or after 9 July 2012. What income/savings did you rely on for the application?

The issues in the appeal or the refusing letter does not seem make mention of the benefits, and it is highly unlikely it will be brought up in court, without a notice having been given to you.

Under the old rules, you were not exempted from claiming benefit, if you are sponsoring someone, provided the presence of this person, will not result in you having to claim additional benefits.

On a balance of probabilities, you should be fine, if you address the other issues on the refusal decision.
