Non-Eu parents of EU living in UK

Post by PAPITO » Sun Feb 17, 2013 10:30 pm

Hello There
For a non EU dependant mother of a German citizen living in UK is it possible to apply for Family Permit instead of tourism visa?
She wants to come for 2 months holidays to visit only but I am aware for Schegen countries they proide you this visa free of charge, is there an alternative if coming to UK or is it right to apply for Family permit and re-apply everytime she is coming?

Thanks

EU rules for non-nuclear family members require dependency. Is she dependant on the EU national's benevolence for her basis needs? If the answer is no, she is limited to using the UK immigration route.

Yes she is dependant, thing is she is only coming for couple of months
And not to live in the UK. We want her to como regurlarly every year or 2 for 2-3 months so will be applying for FP
Will that be OK?
Thanks

An EEA Family permit should be fine.

Be sure to provide sufficient evidence of her dependency on you in addition to other relevant supporting documents. This is crucial to her qualifying and applying under this category.

Only proof of dependency available is money transfer made every month to her. Long ago she was given the FP but she got ill and vould not come so there is that reference.

So, whatever supporting documents you provided back then sufficed in granting her the EEA permit. You therefore should have a clear idea of what to provide now to encourage the same outcome.

If she is the dependent parent of an EU citizen living in the UK, she can visit the UK or move to the UK. Choice is up to her. The application is the same in any case.

Where does she live?
