28 days rule for ILR

Hi Guys, please i need some help with the 28 days rule. Am applying for ILR in april 2013. My details are :

got initial leave on tier 1 general of
Initial: 16 may 2008 - 15 may 2011
extension : 22 April - 21 April.
It seems am 24 days short of five years , can i apply for ILR under the 28 days rule or do i apply for extension first.

Can you please elaborate the dates as to when was your visa issued or when did you land in the UK, as these dates are significant for your eligibility for ILR

I got granted my initial leave under tier 1 in the UK. I changed from Post work study to tier 1.
my tier 1general was approved on the 16 may 2008 - 15 may 2011
my extension from 22 April 2011 - 21 April 2013

Is this clearer?
