Need your help urgently.

I came to UK in May 2008 on Work Permit. After that I was transferred to Tier 2 ICT. My current visa is valid until April 2014. I have been with the same employer since beginning. I need advice:

1. I was in UK since May 2008 until Dec 2012. My project got over in Dec and I came back to India.

I will be returning to UK in April 2013, my 5 years is completing in first week of May 2013. Will I be able to apply for ILR.

2. I was not paid my salary for Jan, Feb and Mar 2013. Will UKBA want to see my salary for all prior months.

3. I was paid arrears in January and February and have payslip for that, will that help my case.

4. Please advice what else would I be needing for my application?

Hi Gagan, I was not getting my usual salary. However, I was getting arrears in both January and February. I have got payslips for both the month.

Please advice.

It looks like you have broken the continuous stay rule by the gap between dec and april when you were away in your home country. can you give your exact dates of being away from the UK?

I left UK on 31.12.2012

I have read that I can apply 30 days before the ILR gets due which is due on 09 May 2013. If that is correct then I can apply on 09 April 2013

Also, under new rule change I can be absent from UK for 180 days in preceding 12 months.

So, my absence from UK is from 01 January 2013 until 09 April 2013.

Would I still be eligible for ILR?

Please please advice.

I am not aware of the latest ILR rules, so let me give this a read and get back to you. However if you are sure of the 180 days that are allowed in the last year before applying, then you should be fine

Definitely CW will check your last 3/6 months Salary slips and Bank Statements of those months. If you have been paid the salary mentioned in your WP and SOC Code list, then you are o.k.What ever they want to check before ,you will have to have your P60s,for the period.
