BNO passport Question & Right of Abode

Hi all, quick question.

Does a British National Overseas (BNO) passport holder have right of abode in the UK as standard or, are the holders able to remain in the UK and work for an indefinate amount of time. This is a general question from a previous post after digging up more info.

BNO passport holders do not have a UK Right of Abode.

The main exception are those who can qualify to register as British citizens under the British Nationality (Hong Kong) Act 1997 or Hong Kong (War Wives and Widows) Act 1996. Once registration as a British citizen is complete, a right of abode in the UK is obtained.

You might wish to have a look at this:

It would seem that if your partner is Chinese, or is not a war-widow, or wasn't registered as part of the mass registrations in 1990 to offset panic-fleeing from HK, she won't be able to register now. In many cases, it seems like full British citizenship was only offered to non-Chinese minorities resident in HK, who would have been "stateless" following the handover. The ethnic Chinese weren't given this option.

It looks like a student visa might be the right way to go then.

Looks like that is the best option as well i think. Any idea how easy it is to switch from a student visa to another type, or is it better for her to finish her course (2 years) and then apply for unmarried partner visa.

This is a nightmare to sort out.................... :shock:

As far as I understand it is possible to switch in-country to spouse visa if admitted for more than 6 months, but someone else will probably know more than this.
