Return of Passport

I have Applied for ILR at PEO-Sheffield via Tier 1 General Visa - myself and 3 dependants. Main applicant has 2 valid indian passports ( 1 is current passport and 1 is lost and found it again but has not been cancelled). Now UKBA has requested to cancel the Old Passport which is found and only this passport has been given back.

Indian embassy wanted to have both passport to get this old passport cancelled.

Please can you suggest what can be done in this case - can i request UKBA to return my current passport ? will my application be automatically withdrawn if i request my current passport?
or it better to go thru lawyer if they can help me in this regard?

did the 2nd passport issued against the loss of 1st one?

Yes, second passport was issued against the loss of the first passport. Copy of Police report also given to UKBA based on which new passport was issued.

You need to wait till your ILR get approved and documents are back.
Your old passport is no longer a valid document, not sure why you send it to UKBA.

I went for ILR Same Day appointment and UKBA has given me letter saying that Application is valid but they cannot take any decision until the Old passport is cancelled and send them back.

Now Indian embassy wanted to have both passports.

So i need to get current passport back - so pls could you let me know options for the same
