Hi,

My wife came to UK as my Tier 1 (General) dependent and this Tier 1 Visa will expire soon in June 2013. I got ILR few days back, however my wife didn’t complete 2 years stay in UK so didn’t apply for ILR along with me. She will only complete 2 years in August 2013

In view of above dates, can you please advise how she can extend her stay?

1) Go for PBS dependent extension in June 2013, before Tier 1 (General) dependent visa expiry and in August when she completes 2 years apply for ILR using SET(M) service

2) Apply using FLR(M) service in June 2013, before Tier 1 (General) dependent visa expiry and in August when she completes 2 years apply for ILR using SET(M) service

She may apply for a PBS extension and subsequently apply for (or vary it to) SET(O) (319C and 319E and Explanatory Memorandum > 7.17-7.21). Unless you are applying for ILR under Long residence.

Thanks Vinny. I already got ILR under 5 year Tier 1 route. Do you still say that she should apply using SET(O) and not SET(M)? please clarify.

I think you need apply using SET(M) for not SET(O).
Select the Family category on below link.

I think vinny is correct here. vd_ilr need to apply using SET (0) form.
Hey guys you have saved my life.. I was going to applying using set(M) form.
Below is my situation :

Came to UK (Work Permit) : 8 Jan 2008
WP renewed : 24 Oct 2008 till 31 Oct 2009
Applied for Tier2 (ICT) : 06 Oct 2009 - 14 Nov 2010
Renewed Tier2 (ICT Established Staff) : 18 Oct 2010 - 14 OCT 2012
My wife came to UK (PBS dependent) : 30 May 2011
I renewed my visa Tier 2 (ICT Long term staff and my wife as a PBS dependent ) : 10 AUG 2012 - 01 OCT 2014
I applied for my ILR : 13 Dec 2012

I am going to apply for my wife's ILR in May 2013.
Do I need to apply using Set(O) form ?
Which category I need to select ? I guess "PBS dependent".

vinny , I am going to apply using SET O form.
I have checked the new form and they do have category called "PBS Dependent". Do I need to select "PBS Dependent" category ?

Hi Vinny,

My wife would be applying for ILR using the SET(O) form in the coming month. Couple of questions:

1) I believe we don't need to complete section 9 in the form?
2) Do we both need to show 6 month bank statements along with cohabitation documents? please can you advise?

3 months bank statements and corresponding wage slips. Cohabitation proof since your last extension up to a maximum of 3 months. That should be a letter each or one joint for roughly every 4 months from a total of at least 3 different sources.
