Visa refused because of bank letter

Post by gulrose786 » Thu Apr 11, 2013 8:47 am

Hello everybody tier 1 ent (psw rute) applied in February first week and got refusal yesterday. Reason for refusal..... Me and my partner had 25k each in our bank accounts here in UK bank. We submitted our bank statements, balance confirmation letters and affidavits stamped by solicitor that money is equally availabe but case raised a issue that bank letters from each side should mention that your money is equally available to both of you. Banks have refused to give us such letters which is against their policy. Expert opinion required for appeal. Regards Gulrose

Same Case with me

Post by Khizar » Thu Apr 11, 2013 10:27 pm

Hi dear, I have got the same refusal reason last week.
I & my friend applied as entrepreneur team and we are having 20k each in our personal bank accounts whilst 10k had been invested already.
We sent our individual bank statements , stamped plus with covering letter from bank, confirming the amount of money, and have also sent partnership contract in which we both declared that we have planned to invest 25k each and have equal shares in our ltd company. This declaration was attested by a solicitor, BUT we received the same refusal reason that we each each side should mention that your money is equally available to both of you.
UK banks don't issue such kind of bank letters.
I have spoke to one of the solicitors and he has advised me that since the banks don't issue such kind of letter but you have supplied the declaration which is attested by a solicitor and is signed by you and your business partner plus you are still having same money, we will fight the case in court and will WIN.
I am not sure what happens next: Any advise in this forum will be highly appreciated as this type of refusals directly effect the two applicants (Team Members).

We got the same refusal last week. We submitted respective bank statements along with the declaration towards each other. Sadly it was turned down. We are already in the process of appeal. I think the best declaration we could make will be in front of the honourable judge. I hope UKBA wont object to that. So my suggestion to all who's applications are refused on the above ground to go for an appeal.

. I would like to thank you for ur response to my query. I m going to discuss with the bank tomorrow about third party mandate option lets see what will come out. Otherwise we must stick with only one point that bank has refused to provide us those letters because it is breach of their terms and conditions and will be punished by FSA. Ukba should amend their policy guidance.

United we Stand:

I am thinking about visiting the personal manager and will ask him to issue me the UKBA specified document, which surely they will refuse to issue me, I will request them to give me in writing that they cannot issue this letter of sponsorship and then I will be presenting this to honorable judge.
All applicants who have been refused on this reason, should consult the experts and follow this if advised to do so by immigration experts.
