ILR Application Doubts

Post by anandh79 » Wed Apr 24, 2013 6:19 pm

6.2 Should we list the absences since we first entered into UK or just the 5 years old absences. Should i take a copy of the sheet to fill up or attach printout of excel sheet.

7.11 6 months of continous period of absence. Is it single absence of 6 months or gaps.

6.2 Your ILR is based on 5 year residence. So you should list your absences during the 5 years. You could do an Excel if all the absences cannot be written on the form.

7.11 Only single absences for 180 days or more. Is it relevant to you??

Hello Kevin,

Thanks for the reply!

I have been living in uk for 5.5 years and was out of uk on the first year around 200 days,

But that was not continuous and also for the continous period calcuation, it will come only to 161 days.

So, I think I am fine.

Hello Kevin,

One more doubt,

should we add the trips where the number of days away was 0 as well. or still show it and mention it as 0.

Regards

I am writing down all trips, even if zero days (i.e. left uk on sat am and returned sun night). The form requires it.

Also, I had same question as you..re 6 months (7.11)- I think I am going to write down any single absence of > 180 days (which is NONE for me).

Hi sunitha,

When you mean by single absence, it is continous say 6 months continuous in any 5 years or 2 months in 1st 4 months in second like that.

I am presuming its single absence of > 6 months (i.e. one trip of more than 6 months out of UK)

I dont understand the logic though :-(

As per new rules, one should not spend > 180 days in every year of last 5 years..then why this question!?

Anyway, the above is my interpretation..

I would reckon what the above person has just said.

The requirement is to have less than 180 days away in each year. So I think it can be put down as

'None - all absences are less than 180 in the given 5,4, 3, 2 , 1 year. Refer to the absence sheet attached

Something on these lines

Otherwise stating more than 6 months absence, which can easily be divided among two years will raise unnecessary speculation. And with the explanation above you are not providing any false data either. So I feel thats a safer
approach.

- It would be good to know others view too?

You need to write if you have absences more than 6months/180 days .
