Which rules apply? BEFORE or AFTER April 6, 2010?

I have 2 Questions for the forum:

1. My Tier 1 general visa was approved on April 23, 2010 for 3 years for dates June 01, 2010-June 01, 2013.
I had applied in March 2010 ( cant remember the exact date) and i have an emails from UKBA that confirm that they started processing my application on April 6, 2010 & an approval email for April 23, 2010 as well.

So, I am not sure if my extension will be based on the old rules placed before April 6, 2010 or after April 06, 2010, since my visa was actually approved on April 23, 2010?

2. My extension interview is scheduled for on May 21, 2013 at a PEO . i have a need to travel out of the country urgently for 3 days, immediately after the interview.

I wanted to know if i will be able to travel on my current (older) visa which expires on June 01, 2013 while my BRP is in process? i have been indicated that a BRP can take 7-10 days from the day of the interview provided the interview is cleared & i cannot travel back into the UK without a BRP?

any comments are immensely appreciated.

Hi Paul

I have a similar profile as yours. I made my initial application Mar-end 2010 but my leave was granted on April 10 2010 (starting in May 2010). Thought my leave was granted with rules in place before 6 Apr 2010 as I got 3 years; but my approval letter mentions that I come under rules in place on/after 6 Apr 2010, since the decision was taken after 6 Apr 2010. Waiting for my BRP card to see the expiry date.

Thanks for your reply. i guess i'll have to cross my fingers till the day comes. i really hope they will give me 3 years. it'll be great as i travelled only after 6 months from the date of visa issue, so i will need another extension to qualify for ILR since i will fall short if i get only 2 years.

Yes I did the same. I travelled abroad with existing BRP 2 days after I applied for extension in PEO. After I got the extended BRP I got that couriered from friend for the return journey to UK.
Before I did that I had confirmation letter about the approval! otherwise u r @ risk if you dont know the decision.

Make sure you got the decision made and carry that letter just for safetly.

How can the case worker treat the rules equally before and after 06/april/2010?
