i am new member in this forum ,
i will write to you my case and i wish i will have some help from experts or some one had the same experience.

ME:

- 23 years old
- from TUNISIA
- special student (allowed just to pass exams)
- valid Tunisian passport like "student" ( i visited libya in may 2012)
- i have bachelor degree + university inscription for this year , 3 job experiences (marketing)
- no criminal history
- i am not working .


MY FUTUR WIFE :

- 35 years old
- from POLAND
- she is in UK more than 7 month
- she have rent house contract
- she pay tax
- Permenant Job contart.
- DIVORCED in 2009
- able to show and proove her ability to support me when i will be in UK.


=> we will get marriage in July in TUNISIA .


1/ she will be able to apply from UK for eea visa for me ??!!
2/ what i need to prove to get or to show to embassy (skils , english level , culture ...) ???!!!
3/ what can you advise me to do to make our application strong ??!
4/ we can applyy after marriage ?!!
5/ the stamp of Libya visa in passoprt can impact my application ?

Personally looking at your case I would not apply for UK visa, but schengen visa to any EU country, then make your way to UK.

Looking at your age difference, and the fact that most likely you will want to apply just after you get married, you may be suspected of marriage of convenience, and despite the fact that UKBA in theory should investigate your case and prove marriage of convenience, they for some reason don't feel like they have to, no obligation on their side.

Thru sweats and struggles you will manage to get to UK but it may take you months.

thank you , but just for informations , we met each other 2 time before , we rent house , we had normal life , and marriage will be with members of familly so , i think that is not like a WHITE MARRIAGE !!
and about age , i know many couple eveen with bigger difference and they get not problems

Better would be to apply EEA family permit in the presence of EEA national in order to promptly clarify any suspicion arise towards the relationship in embassy if needed.

Really i am confused , Everyone have his own opinion in the subject ,

from what you say :

1/ The most important is MARRIAGE PROVE
2/ Looking at age diffirence we will have problems

and some people told me about my wife situation ,

Justinyk, first of all you shouldn't be so worried about things you have not done just try and put yourself together and get married first, Age doesn't matter if you're in a true relationship. A Libyan stamp on your national passport shouldn't be a problem.

Justinyk, your wife does not need to prove that she can support you in UK, she just needs to give evidence that she is exercising treaty rights, which means working, or self-employed or self-sufficient. On your part you just need to provide passport and marriage certificate.

Age difference should not affect the case as long as the couple is in mature age and possess mutual consent along with the required evidences to prove the relation.

Hi JUSTINYK,

If you are in love with this woman and prepared to live together, and your relationship is genuine and properly documented, then you have nothing to be worried about, if they refuse because of your age difference and think your relationship is one of convenience, then you can always appeal the decision.

Get married, provided evidence of the genuine nature of your marriage, and then take it from there. I wish you all the best.

An other thing ,
i read in Internet , Forums , and Even UKBA web site , and other people experience ,
about the main problem and the reason of 80% of Refuse.
After 9 june 2011 new rules has been imposed .

SALARY AND ANNULALY INCOME :

1/ the 18.600 GBP required , is BEFORE or AFTER tax .
2/in job contrat there is :
a-what receive in your account NET per year
b-the annual salary without taking insurance and tax

3/ what is the story about 16.000 GBP OF SAVING !?
did we need 16.000 in account + a contract with 18.600 ??



EXEMPLE : my future wife have PERMANENT CONTRACT 1500 net per month //18.000 GBP , NET (after TAX , the money she found in bank per year )

in what case we are ?!

Post five years, having complied with the two above, no conditions.

For the non-eu spouse, it is simply a matter of residing in the UK with the eu spouse.

im really have a lot a questions (i just read about that and im puting what many people in different website say ):


1/ Do i need really to prove and to pass English test in embassy or bring some diploma like "PET" ??

2/ In UK Embassy in tunis or where ever , is true that they doing Tests for English culture and life style , writing and speaking and... ??!

3/ How kind of visa i need to apply for ? EEA1 or 2 or what exactly ?

4/ And from where i can get THE FULL LIST OF DOCUMENTS that we need both (me and my spouse ) ??

5/ its really so important to have copie of previous passeport ?!!! i change it since 5 years !!!

6 and what is your advices to make strong application with all provements ??

7/ the fact that my statue in passeport is "STUDENT" impact something in procedure ??


maybe i am asking so much , but i am sure that many friends was excatly like me
