Relative arrested for overstaying visa. What now?

Post by ender5 » Thu May 09, 2013 10:30 pm

A relative of mine was arrested in London for overstaying his visa today. What will happen to him now? How do I get in contact with him? He does want to go back and I could easily book him a flight back home. I don't know who to contact or what to do. Any advise would be greatly appreciated.

He will be sent to a detention center and removed within 3 days.Once in detention he will be allowed to make one phone call.

If he had a basic phone whilst he was arrested which is not capable of taking photos or assessing internet he will be allowed to keep it.

When he is interviewed before they issue him with his "ticket" and he indicates he wants to go back he will be sent without escorts.

I don't think you can pay for his ticket as they have probably booked one for him already.

How long has he overstayed?

I am just curious how did they know he did not have papers if he was arrested in public transport?

Have you heard from him?Just for your information those 3 days don't include weekend only working days.

Has he had removal directions set?

Post by imran1508 » Sat May 11, 2013 5:09 pm

If he wishes to remain in the UK and does not yet have removal directions set then he could do the following (depending on his circumstances):

If he is in a relationship with a british citizen he may able to submit a FLR O application. Thereafter he can apply for temporary release and/or bail.

Alternatively if he has a convention reason for fearing return to his country he could claim asylum and ask to be released whilst his matter is pending. this has many implication depending on how credible his claim is.

If he is happy to go back then I'm sure the Home Office will be making arrangements for him very soon.
