URGENT- tier 4 visa sponsors licence suspended

Post by sampraja » Wed Jun 05, 2013 10:24 am

hi my name is sam and i have been in uk from last 9 years on student visa and recently in jan because of my illness i have to fly back to India to see my psychiatrist. i was under sever depression so i have to stay back to india till now. i have informed my college about this before i flew back. my tier 4 sponsor issued me a letter mentioning the reason of my absence. recently i have heard that my tier 4 sponsors licence was suspended on 9th may and they gave all students transfer to another college. now i need to apply for tier 4 student visa for new sponsor. can i go back to uk on my visa issued on previous sponsor? as i dont want any gap for my 10 years stay. if i provide them with my doctors letter and conditional letter from new sponsor and previous sponsors letter mentioning about my illness? i have enough money to show in my account for new tier 4 application and my new tier 4 sponsor is ready to issue me CAS when i land in uk. so do u think that they will let me in the country? plz i need urgent advice on this guys plz help me out i dont wanna ruin my 9 years stay for this silly things. thanks

You will face questions upon your arrival. It will be hard for you to justify your return when your current sponsor has a suspended license. IMO, if you left the UK while having a valid leave, then what you could do is, apply for a Tier 4 entry clearance (provided you meet all the requirements) If you have not already spent 5 years below degree level and you get a fresh entry clearance, your long residency will not be effected. I would advise you not to try re-entering the UK on current leave.

Contact solicitor in Uk from India before you fly and explain the situation, they may help you out.

When an institute's licence is revoked then the students who are inside the UK usually receive a notification from UKBA giving them 60 days to either join new licensed sponsors or leave the country. But how will it apply in a case where the student is out of the country there is no idea but best would be to call UKBA before trying to enter.

Get a new entry clearance and there will be no gap in long residency.

I don't think they will let you enter in UK easily. Specially when you are near to finish your long residency.

I think you can travel back to UK within 60 days. Consult with some good immigration lawyer immediately who can receive you here at UK airport than make a journey plan according to his advice.
