(ILR) or another extension ?

Hi,

In brief, I am a Tier 01 (General) holder. My (entry clearance visa)was issued on 08.11.10 . I entered the Uk on 05.03.11 then went back to my Home country on 29.03.11 .After that I came back to the Uk on 18.05.11 and have been living in the UK till now. I also managed to extend my visa (leave to remain) and luckily it is valid till 28.01.2016.

+ My query is :

Will I be eligible to apply for (ILR) on next 28.01.16 or I should apply for another extension ?

I understand that I should not be out of the Uk more than 90 days per year.I know that I entered the Uk 4 months after my visa was issued. But If I take( 28.01.16) into my consideration and take away 5 years from that date I may consider (28.01.11) as an entry clearance . In this situation I will just be out of uk for 86 days.

The ILR rule is very simple.If u enter UK within 90 days of initial EC then 5 year qualifying period starts from the EC date.If entry gap is more the 90 days the qualifying period starts from date of entry to UK.


Your EC Date = 08.11.10

Your Entry into UK = 05.03.2011

GAP = 117 days which is more than 90 days


So your 5 year qualifying period starts from 05.03.2011
ILR Date=05 MARCH 2011 + 5years =>05 March 2016

But u can apply within 28 days so

05 March 2016 - 28 days => 06 Feb 2016 ( ILR Eligibility Start )

I think u have to go for 2nd extension..
