Child benefit

Post by lck » Sun Jun 09, 2013 11:41 am

Hi I recently got ilr and my wife has applied for her flr(m) visa. My question is can I claim child benefit for our uk born son? will it affect my wife's flr(m) application and subsequently later her ilr application? Can someone please help and answer this. Appreciate your time and help. Thank you.

You can claim Child Benefit in your name without it affecting the applications. Though, under the new rules is will not count towards satisfying the Financial Requirement

If you wife is under the new rules for a spouse there are financial requirements and for such, the benefits cannot be included in calculating your income.

Yes you can apply for child benefit in your name as you're now settled. A claim for tax credits would have to be in joint names as you're a couple, neither of which would affect your partner's NRPF restriction.

You can make a claim (joint) but whether you're entitled to any tax credits is a different story. It will depend on your circumstances, see here (click) to run a calculation but based on your income you're unlikely to be entitled to any tax credits unless you/your children are disabled.
