can I register my daughter as British?

Post by ileshpatel » Tue Jun 18, 2013 1:53 am

My daughter was born in India April 2008,and she still in India with her grandparents, due to visa issue, but now I have received my British citizenship, and my wife has Spouse (Leave to Remain) visa based on me

My question is can I register my daughter as British?

Please help me as I can't find a clear answer on the internet

As your daughter was born abroad her registration will be subject to discretion under section 3(1) of the British Nationality Act. The child should be in the UK and they would generally expect her to have been in the UK for at least 2 years, though this coud be waived since she's young but the being in the UK would not.

Have you read the FAQ before posting?

See Q1 & Q2 in Citizenship FAQs - Common Questions - Read before posting - children.

The HO would expect your wife and child to hold ILR before applying.

pennylessinindia has already answered, so why start another topic with the same question?
