switching from Tier 4 dependent to Tier 2

Hi, I am in the Uk since April 2010 on a Tier4 dependent visa. I would now like to switch from this category to Tier 2 general. Does the cap of 20700 apply in my case. If so, how is it managed, is it first come first serve or lottery based.

you should read the dependant policy guideline and the tier 2 guideline.
