Hi guys,
I wanted to know if we can appeal within the 10 days of refusal , withdraw appeal and re-apply again on the same day of appeal withdrawal?

You will become an overstayer the moment you withdraw your appeal regardless of whether you re-apply or not.

NO!!!!! Any new application will be refused if there is an existing appeal.

Any document to prove this ?

If your appeal is pending, but you wish to make a fresh application under any allowed category then you can apply any time and withdraw your appeal. Because case worker do not touch your application before your biometrics.
You have only one chance of fresh application though.

I agree with this, if you dont withdraw your appeal and make fresh application then your application will be refused.
Best thing is, post your fresh application today and withdraw your appeal at next day. (make sure your fresh application is received by the HO before withdrawing)

What is the reason of refusal if I may ask?

Is your visa still valid?

Our Team visa was refused stating they felt the business was not genuine coz third party funds were not invested! We were waiting for visa to come so that we can then invest.

We have now invested and will be making a fresh application once the appeal is withdrawn.

do we need any specific documentation to show for the funds invested now?

I have been quite busy and hardly read the forum post. I hope you made the right decision by now.

Why don't you go ahead with your appeal?

If your business legally registered in UK and you have a legal business even though u have not invested the funds, the best thing is to challenge the decision. You will have more chances to win with appeal relying on what you posted.

If you have invested the funds, yes you will need all the required document to show that funds have been invested.

I think your case is winnable and you don't need to reapply because nobody should expect us to invest £50,000 in the country where you are not yet allowed to stay. The judge will allow your case but if you have any other refusal reason please take that into consultation as well in your decision
