can i apply this form and be successful?

my situation:

1 year 8 months married, 1 year 6 months visa.
now divorced, in another country, not in ireland.
baby in the state.
baby and mom EU, not irish, baby just born in ireland.
i support baby and mom.
mom have no job.
i have job and i can prove i can remain in my own in state.
visa expires in 2018.

i read just can be accept if the mom working or living constantly in the state.

i just know that, i have a baby in ireland and i dont stay far away.

u can apply for form EU 5 but the condition is that the marriage should last for at least 3 years and the EU spouse should be exercising her treaty rights in the state. So at the moment u r on the mercy of DOJ and in the current circumstances where every EU spouse is applying for retention and PR card, it's difficult in ur situation but best of luck
