Absence due to UKBA fault.

Hi,

I am planning to apply for ILR (Permanent Residency) in August 2013. Based on the following data, can some one please advise if my application would be considered or rejected?

I have been in the UK from Oct 2007, but on a business visa.


Left the country in Dec 2007 and applied for a Work Permit and re-entered the country on March 7th 2008. (My qualifying period starts here)

Because my project was terminated all of a sudden, i had to return to India on 22nd Dec 2008 (though my work permit was stamped till July 30th 2009). Once back in India, i applied for a Tier 1General Visa on Jan 15th but the application was rejected initially. I gave it for Administrative review on Feb 6th 2009 and finally was granted entry clearance on the 28th Aug 2009. I entered the UK on the 30th Aug 2009 and have been here since except for 2 trips to India for less than 30 days each.

So would my absence, during the period 22nd Dec 2008 - 29th Aug 2009, be against me, when i apply for ILR, though it was UKBA who delayed my trip, by that amount of time, due to the review process?

In March 2013, my five year period from March 2008 would be complete with initial qualifying period in Work Permit and then Tier 1.

The period between changing visa from WP to Tier 1 is what I am concerned about as UKBA delayed the process which meant I couldn't return to UK.

I would really appreciate any sort of advise in this case.
