ILR for Spouse

Post by AA1 » Mon Aug 05, 2013 9:07 am

Hello

My wife has got a 2 year spouse visa granted in March 2012, and she arrived in the same month after about 1 week of being granted the visa.

I understand to get ILR she will need to do the Life in the UK test and another CEFR English Test at level B1 in Speaking and Listening from the list of approved tests as she will be applying after October 2013.

Her spouse visa expires in May 2014 9checking the passport - my question is when should the settlement application be submitted , will it be 28 days before March 2014 or does she have about 28 days before the visa expires in May 2014.

She can apply 28 days before the completion of 2 years residence.

Thanks CR001 - just to clarify the point. For example say she needs extra time and does not pass the required tests until April 2014 - will she still be ok to apply for settlement as she will have gone over the 2 years but still within the spouse visa expiry date of May 2014.

Yes, as long as she applies before her visa expiry date, it is fine.
