yeh but if it's going to be rejected can he appeal? coz he might be classified as an overstayer?John wrote:miryferny, the problem is that the regulations say that they must be in a "durable relationship", and UKBA interpret that as needing to live together for at least two years.
However it seems to me that it is totally possible for a relationship to be durable before two years has elapsed. So they might consider applying for a Residence Card, getting refused, then appealing and taking a chance before the Tribunal.
