Thanks god. today got a letter from the court saying appeal allowed.thanks very mush for everyone.
Now i have to wait either HO going to appeal or not to the upper tribunal.

1. Can i know your hearing date and in which court you attended i mean location ? is it in hatton cross or some other place

2. What are the arguments went in the court , did home office lawyer raised any cross examination or any kind of questions ?

I had appeal hearing date on 06 August 2013 at Hatton cross and today I got the decision that judge allowed my appeal. Surprisingly got decision with in a week. Let's see how long I have to wait for my visa and documents.
Refusal reasons are:
I don't have 50k in my account and
Contract is not specific.
Both reasons are with out any fact and even the UKBA representative cant prove the refusal reason. the hearing was over in 5 minutes.

1. Did u hire a barrister ? or do u appealed by ur own ?

2. I got refusal with reason no landline and email id in contract and does not seem to be genuine Entrepreneur my hearing date is in November at Hatton Cross .

3. What are the questions askes by UKBA ? did they ask any questions to you ?

4. Because my lawyer is saying that if applicant attend to the court they will cross examine the applicant and try to complicate so he is saying that no need of my presence in the court is that true ? Cant I
simply go and watch the proceedings in the court ?

Please help me with queries

You have to attend the court to know the hearing proceeding.
I hired the barrister as he is there for arguments. he told me that if HO barrister ask irrelevant questions I will take care of it.

The UKBA representative did not asked any question from me.The barrister would be required as my barrister prepared the skeleton arguments those were really nice with relevant law cases and he presented those to judge.

Congratulations for your successful appeal.
I got same refusal reasons:
1. Not having 50K
2.Contract on another company (the company with whom I had contract) letterhead
3. Not genuine Entrepreneur

So can you please tell me what further documents you submitted to prove your grounds. Did you submit updated bank statement of 50K

ur solicitor will prepare the bundle and u ll discuss all the relevant documents with him/her.In my case all the doc submitted with application were enough so I as precaution just take latest bank statements on the day of hearing, otherwise it was not required.
On the day of hearing ur barrister would provide the skeleton arguments to judge.

the contract should not be on letter head,it should be on plain a4 paper and signed by both parties with all relevant details.

When did you send your bundle? Do we need to include new statement with the bundle?

this is cheering news!

my refusal reason is similiar to yours - ''contract did not explain the services provided'' when it actual fact it contained 8 lines of the services provided by my business.

glad to hear that the HO representative could not justify the refusal reason too.

i tap into your testimony and I pray i will also have the same testimony/good news to share soon ! :)

Congratulations Chella. Same God that did it for you will do it for all of us. My appeal was met to be on the 5th of this month but I got a letter from the Tribunal that HO has withdrawn the original decision and since then I have not heard anything yet. Hopefully, I will wait for the outcome

it is good news that HO has withdrawn its decision then you can directly get the visa from HO as they intimated u already.
In my case my solicitor tried to persuade HO prosecutor for withdrawal although she didn't have any reason but she didn't withdrew the original decision.
