Work permit and redundancy

Hi Everyone.

I have a 5 year work permit sponsored by my employer. They are now restructoring and I have been made redundant. My notice month just started.

I have the following questions:

1. How long after my employment ends may I stay in the UK, I seem to remember seeing 28 days somewhere, please confirm. Obviously actively seeking new employment.
2. Is the process of moving to a new company really as seamless as I have been led to believe? I have been told that once you have a permit, getting it moved is a quick process and does not involve the adverts like the first time.
3. Are there any specifics I need to be careful about avoiding as to ensure a successful transition to a new company?

I have been in the UK now for 3 years, first 2 on Holiday Makers, recently bought property etc, I really need to stay. If it was not for the HSMP changes recently I could have been on that by now.

Any help or advice appreciated. :D

You have 28 days to get a new WP or move to a different category of the visa.

Otherwise you'll have to leave UK. Sad but that's what the rule says!

If worst comes to worst that you failed to find a job and you need to leave UK (I hope this will not happen), I bilieve you can claim some money because you lost your job due to redundancy.

Senior members / moderators will comment further but as per my understanding the answers to your questions are

1) You are only required to leave UK if you get a notice from HO to leave within 28 days. Basically when you are made redundent your employer needs to inform home office and in turn home office writes to asks you to leave within 28 days. Now the process itself may take a couple of weeks if not months between your employer informing home office and home office writing to you. In practice, usually the employers do not inform home office and in that case you can stay on your current visa till it expires, but expect problems when you try to re-enter UK using your current visa as the IO usually asks if there has been any change in your circumstances. So in practice you have a couple of weeks (months) to sort out your new work permit.

2) The process of moving to a new company is seemless. I know because I have gone through it myself. There is no such thing as a work permit transfer though. Basically as long as the type of work is same as your previous work permit, your new employer does not need to advertise the vacancy. In my case the new work permit was sorted in a week. The only thing is to find an employer willing to file a work permit for you.

3) I am not aware of any thing in particular you need to be careful about to get your new work permit. As long as the job is the same as the previous one, it should be a fairly straight forward process.

jazbaati99 said the facts. I myself went thru the whole process once and in know how stressfull it is.

your 28 days countdown starts once you leave your current job. but employers may not (depends on your relationship / understanding with employer) inform HO quickly, allowing you to look for jobs.

During WP under new employer, HO may ask you to show your last salary slip (but not always). Unless you can show previous month salary slip, the application will be considered a new WP application rather than change of employer.

How if the job is the same but job title is different?

My case is that the job is in Healthcare but the job title isn't the same. But it is similar job just another type of project.

Please advice.

As long as the work description remains same (more or less) you should be fine. The title does not need to be the same.
