Eligibility date for ILR

Hi,

I'm sure this question has been asked many times and I've been through everywhere but I keep getting conflicting information about the date to apply for ILR!

My wife was granted a spouse visa in Islamabad

Date of issue: 21st April 2005
Date of arrival to the UK: 15th May 2005
Date of expiry: 20th April 2007

Question is, when is the earliest I can apply for ILR?
Is the 16th April (28 days before arrival)
or is it the 23rd March (28 days before expiry)

The HO helpline said 16th April, but I cant find it written anywhere in the rules that it HAS to be 28 days prior to arrival!

hi everybody . I am also interested in this question .I got spouse visa from pakistan 2 days before,when should apply ILR,28 days before visa expiry or 28 days befor arrival ?

4 WHEN TO APPLY
You must apply before the end of your authorised stay in the
United Kingdom. For applications on Form SET(M) you have to
complete 2 years in the category to qualify for indefinite leave
to remain. Please do not apply more than 28 days before
completing that period. If you apply earlier than that, your
application may be refused. If that happens, we will not refund
the fee and you will have to pay again when reapplying.
If you delayed your journey to the UK for weeks or months after
obtaining a visa as a spouse, civil partner, unmarried or samesex
partner, you may need to apply for an extension to make
up the 2 year period. In that situation, you should apply on
Form FLR(M). If you are unsure about this, please call 0870
606 7766 for advice.
