Is Set (M) the right form and documents required

Hi,

I received my ILR visa in Sep 2011 and my wife received her two year residence permit (based on application as the partner/spouse of a person resident in the UK) on Nov 15, 2011. I think we applied using the FLR (M) form but not sure.

We are planning to apply for ILR for my wife. My doubts are
a) Is SET (M) the right form to use
b) I am trying to book a premium service appointment 28 days before the expiry of visa and the web site is giving me instruction that I can only book the appointment 40 days in advance of the requested date of appointment? Is this right?
c) My wife has passed her Life in the UK test in Sep 2011. Can she use it as proof for English eligibility if we apply before Oct 28th?
d) What are the documents that needs to be presented?

3. Life in the UK test is not a test that measures listening and speaking proficiency as prescribed in the immigration rules.

What was your spouse's visa before applying for flr(m)?

The life in the UK test will meet the KOLL requirement for settlement (the new requirement applies after 28 Oct 2013).

My wife moved to UK in Feb 2006 as my dependent and I was on WP. Then she got a job in UK and she moved to HSMP and she remained on that visa till Nov 2011 when she applied for visa to remain in Uk as the partner of a resident.

Does this make a difference.

No as she was not a dependant before the application. She can apply for ILR/set(m) from 28 days before 15-Nov-2013, you can only book 40 days in advance and full fees now need to be paid online when you book.

See here (click) to understand the process. If you are British, she can possibly apply to naturalise as British straight after getting her BRP for ILR.

Make sure your wife applies between 18-Oct and 27-Oct, so as to avoid being subject to the new English requirement being introduced on 28-Oct-13.

When I was looking for the guidance notes on Set (M) form today, it mentions that "If you are applying as the partner of a person who last had leave as a work permit holder, a relevant points based system migrant, on the basis on UK ancystery or in any other temporary work related category and they now have indefinite leave to remain or have been granted naturalisation this is not the correct form to use"

What does this mean? I would like to reconfirm if SET (M) is the form to use?

I am applying for the SEL(M) on the 22nd of Nov.

I have done the tests.

My only question is, is the set m form going to change after the 28th of oct when the new rules come into place, or the form stays the same?

SET(M) will change and you can only use the old form for 21 days after 28-oct-2013. The change will introduce a B1 English requirement.

I have already passed the B1 test and life in the UK.

So in my case i need to wait for the new form to be released and take it with me on the 22nd of Nov?

When the new form will be released, also will the structure of the form also change ie, more questions etc...
