Help Please- ILR Dependent Eligibility - Tier2 Long absences

Post by tvnaveen78 » Tue Sep 03, 2013 12:23 am

Hi

Below is my case can some one help me out in judging whether my dependents are eligible for ILR or not.

My Wife first came to UK on 12/10/2008 - Entry Clearance 1
Out of UK from 28/06/2009 - 22/11/2009 - 147 Days
Out of UK from 26/05/2010 - 09/09/2010 -106 days
(Visa expired on 11/07/2010) so new dependents visa issued in india from 09/09/2010 - Entry Clearance 2 - Visa tier2 Partner
Out of UK - 10/12/2010-17/01/2011 (38 Days)
Out of UK - 03/09/2011 - 07/10/2011 (34 Days)
Out of UK - 10/06/2012 - 10/12/2012 (183 Days)

She had her VISA extended in April 2013 to July 2014 as Tier 2 Dependent

What will be the date of entry to UK will it be the first Entry clearance date or second entry clearance date?

And since she has not stayed in UK continuously is she still eligible for ILR?

Child-----
For my first child she was born outside UK and the entry dates are same as wife's. Is she eligible for applying ILR?

Please someone help me out....

I have looked through the link but still can't understand the 2 year continuous period clause.

Help Please- ILR Eligibility - Tier2 Long absences

Post by mnagella » Sat Mar 07, 2015 10:58 pm

Hi all experienced members and gurus, please can you help answering some of my questions.

I have quite a high numbers of days out of the country one year.

Entry and Exit to UK

1. 6 Mar 2010 - First Entry to UK
2. 3 Aug 2011 - 8 Feb 2012 - 190 days(Went to business assignment)
3. 12 Jul 2014 - 3 Aug 2014 - (Annual leave)
4. 27 Aug 2014 - 27 Sep 2014 -30 days( Went to business assignment)

1. In my 2nd year (highlighted in bold above) I had a long business assignment in India (not my home country) that stretched out for a total of 190 days.

2. Everything else is pretty straight forward: no criminal conviction, has always been with 1 employer the whole 5 years,
3. Now I switched to Tier2 Genreal from 27 Feb 2015 onwards( Visa validity 27 Feb 2015 to 26 Feb 2018) .

Could you please let me know when can i eligible for ILR.

Thanks,
Mallikarjuna
