Tier 1 -> ILR for myself and my partner who came in Nov 2

Post by satp2519 » Wed Sep 18, 2013 3:46 pm

I am on Tier1 (General) visa eligible for ILR in october 2012 and my wife (partner) is a dependent on me (Tier 1 General).

1. I need to confirm about any maintenance funds that i need to maintain for my ILR visa or not.

2. My wife she came to UK in Nov' 2012 and will have almost a year living status in UK by time she applies for her extension. Just want to confirm on which visa category she needs to apply and how much maintenance funds she/I needs to maintain for 90 days. can we both apply on the same day with the same bank statement for both of us. If so, how much do i need to maintain for her and for me (if there is any that i need to maintain).

3. I have been reading lot of posts and SET (O) form Tier 1 -> ILR applicatons, its not clear about the maintenance funds and even here some say not needed and some its needed. so can some please clarify this.

I am working continuously for the last 1 year till my extension date due in November 2013, is it mandatory to show them the P60 or the last 5 yrs work history ?

awaiting for your quick replies on this.
Many thanks in advance.

1. For ILR Application there is no requirement to maintain fund. As she didn't live with you more than 2 or 5 years (You need check that condition) in either case your wife is not eligible for ILR. So, dependent need to apply for a different category

2. She need to apply for Tier1 General Dependant to extend her stay. For which you need to maintain fund for the last 90 days which is usual procedure you follow for Tier1 General.

3. P60 is not mandatory for ILR. But if you ring HMRC and ask for last 5 years consolidated Tax statement they will send it to home which is suffice.

Tier1 Dependant must be applied following your ILR application process. However if you are applying by PEO you can request for an appointment for later time of the same day explaining the situation. (In Croydon PEO they provided me one for my Tier1 Dependant when I applied for ILR this year March 2013, but things might have changed).

If you are applying by post, must send both the application together to your ILR Address with the covering letter with explanation. After yours is processed they send it to Tier1 General Process.

Likewise, in the thread somewhere members have listed the checklist which may be helpful for you.

my situation is that i am going for ILR visa this November'13 switching from Tier 1 Category to ILR having successfully completed my 5 years of stay on Tier1. I meet all my requirements and ready to go for ILR.

The question is about my wife's visa status and what visa will she need to apply for. At the she is my dependant and has got Tier 1 dependent, but once i apply for ILR and got the ILR, i won't be on Tier 1 and she won't considered as Tier 1 dependant. As she came in November' 2012 she is not eligible to apply as ILR dependant along with me.

So please advise what she needs to apply for her extension, earlier i posted in here as was advised that she should be applying for Tier 1 dependent visa extension, but some of my frnds advised that's not the case, she should be applying for FLR.
Please let me know more info about this situation.

Many thanks in advance

Thanks for the reply again.
regarding my wife's dependant visa when is the earliest that she can apply for her Tier1 PBS extension. She got the visa valid until 10.01.2014.

Is there any thing like 28 days before the expire date ?

Myself being the Main application switching my existing Tier 1 Category into ILR this November' 13, she won't be no longer on Tier 1 Dependent as i will be on ILR from November' 13.

so based on this situation, when does she need to apply.
She is wishing to apply in Nov last week or early December' 13.

Please advise on this...

Thx
