Switching from T2ICT to T2G

I am granted T2ICT Established Staff visa in July 2010 for 2 years then extended for another 18 months in July 2012 , now my current T2ICT is valid till Jan 2014 , my questions below please help

1) Am i eligible for ILR after 5 years stay in T2ICT ?
2) Can i switch to T2G ?
3) If i can switch to T2G , do i need to serve cooling off period ?
4) Will i be eligible for ILR if i switch to T2G ?
5) Do i need to leave UK & return when i switch from T2ICT to T2G ?

No I believe..

Yes if u switch sponsor.

No, but you have to travel to the home country to apply I believe.

4) Will i be eligible for ILR if i switch to T2G ?

No I believe, try finding and reading the PDF in ukba websites which clearly explains these things..

5) Do i need to leave UK & return when i switch from T2ICT to T2G ?

2 years or the length of the engagement whichever the shorter (there is no limit to the number of extensions)
3) Can I become eligible for ILR if I stay for 10 years on this T2 ICT ?
yes provided you meet all other requirements

Hi Manci,

I got my Tier 2 ICT established staff visa stamped on 2011 March 15. I've renewed visa twice in UK (2012Mar- 13 & 2013Mar - 2015 Mar) in same Tier2 ICT category. I have got a new sponsor now and trying to switch to Tier 2 General category, I have following doubts,it would be great if you could help with these questions.

1. I've already spent 3 years in UK in Tier 2 ICT category, Now if I switch to Tier 2 General visa, Can I stay for 6 more years? I want to understand if the 6 year limit on tier 2 general includes the time spent on Tier 2 ICT as well?
2. If I can stay for 6 more years on Tier 2 general, Can I apply for 5 years while switching as per 2014 rules (given that the sponsorship offered is for 5 years)? Can I also do one more year extension or apply for PR at the end of 5 years?
3. If 6 year limit includes Tier 2 ICT period as well, Then after switching to Tier 2 General, am I eligible for PR in 2 years (in 2016)?

Could you help me with this? In the thread below, it says the total 6 year period includes time already spent on initial Tier 2 ICT as well, so I am confused.

There is a difference in wording between the current immigration rules and the SoC with regard to the question you asked, i.e. whether the time under T2 ICT counts in the 6 year limit or not. It may be that the SoC was not correctly drafted. To get a definitive answer better wait until the revised immigration rules are published which should be shortly.

As the new rules are out from April 6th, I am referring section 192 in the link below, it doesn't particularly say that the 6 year period for tier 2 general includes the time spent on Tier 2 ICT. So I can stay for 6 more years if I switch to Tier 2 general now right?

The wording of the SoC has been lifted into the April 14 version of the Immigration Rules and there is now an apparent discrepancy between the T2 policy guidance (para 192) and the Immigration Rules (245HE). The HO's attention has been drawn to this.

you cannot switch to T2G in the UK, you would need to return to home country and apply from there (with a CoS) but you can only do this after 1 year cooling-off.
