ILR - Absences from the UK

Post by gulz » Sun Oct 20, 2013 7:02 pm

Hi All,

I am due to apply for an ILR at Croydon PEO on 15th Nov using the Tier 1 General route. All else is fine when it comes to filling the new SET(O) form, except for section 6 wherein I have to give a list of absences from the UK. I have had continuous presence in the UK over the 5 year period. However, I have made a lot of small trips to various European countries during this time (I have a list of every trip I made, with flight/train/ferry tickets, etc). The total amounts to about 190 days over the 5 year period. Of these 190 days, about 21 days are work related.

In section 6 of this form, I am required to provide all the absences from the UK with a reason for absence and related evidence. The form says "Evidence of all work-related absences (including paid annual leave) is required from those applying under Tier 1 (General)...". My absences that have occurred due to leisure reasons took place mostly on weekends, sometimes including a day or two of annual paid leave. Now my two problem are:
- A lot of my holidays were taken in 2009 and 2010 when I was working at my previous employer. The whole management of that organisation has changed since a buyout. When I recently contacted them, they said they were able to give me a letter to evidence absence from the UK for the business reasons, but not for my leisure trips as they were not aware of my presence in/absence from the UK on these days. Although I have not yet contacted my curent employer for getting an avidence of my annual holidays from them, there is a good chance they will have the same stance as they hold no responsibility for my presence or absence on my days of paid annual leave. How to I tackle this situation? What sort of alternate proof can I offer the home office? Are my payslips sufficient evidence?
- For the days that I have taken a day trip to France, or went away for a bank holiday weekend to Germany, etc, the annual paid holiday was not used, so no one can vouch for my whereabouts on those days. Will I need to give my flight tickets to prove that I was out of the UK for leisure reasons on those days? If so, what evidence can I supply?

You are fine; u don't need evidence; leave reason blank as many people did and got success. Surface some posts and you can clear more to manage; prepare cover letter and sheet of leaves; samples are availabe on this forum.

Further clarification on this matter please,

I was granted a work permit in Sep 2008, I worked for this company until July 2013, During this period I have been out of this country for a total of 82 days. I am struggling for documentation on this, the best I could show is my stamps on my passport and my flight tickets for these periods. Finding employment records is difficult (lets say its not available).

In july 2013, I moved to a new employer on a Tier2 visa, I have no leave of absence from UK since them.

What are my alternatives ?

I am looking to apply for ILR soon.

The expectation is
245 SD - B. A letter from the employer detailing the purpose and period of absences in connection with the employment, including periods of annual leave. Where the absence was due to a serious or compelling reason, a personal letter from the applicant which includes full details of the reason for the absences and all original supporting documents in relation to those reasons - e.g. medical certificates, birth/death certificates, information about the reasons which led to the absence from the UK

Thanks.

As UKBA expects to see relieving letter and leaves approval letter from every past employer, but is it required that the letters need to be recently issued ? I mean suppose if i take a letter today from one of my past employer and produce it to UKBA in one year time will it be good enough ? or i need a new letter that time with a recent date ?

Thanks Sarfi, this is most helpful. My previous employer is getting the letter ready for me detailing my business trips and the total annual holidays allowed per year. I'll get a similar letter from my current employer too.
