When can I apply for citizenship?

Post by laudo9 » Wed Oct 23, 2013 10:03 pm

I am sorry is this has already been covered but I am not able to figure out exactly when the start of the residential qualifying period was in my case.

Marriage visa issued: 01/06/2011
Date entered UK: 21/06/2011
Married: 23/07/2011
FLR(M) granted: 28/10/2011
ILR SET(M) granted: 22/10/2013

Would the start of the qualifying period be the date entered the UK or date FLR(M) temporary residence was granted?

For naturalisation the count goes backwards from the day the application is received by the HO. If you are married to British citizen - 3 years. Otherwise, 5 years.

I'm slightly more confused now.

Does this mean the date I applied for the marriage visa in Ukraine or the date I applied for FLR(M) while I was living in the UK?

I understood that you can only count time actually spent in the UK?

I am married to a UK citizen so it will be 3 years. I just want to clarify when to apply because I know it's critical to get the timing of application correct or lose the application fee.

Date entered UK: 21/06/2011

If you are the spouse of a British Citizen, then you only have to be resident in the UK for 3 years under any leave. Furthermore, you must have been physically present in the UK 3 years before the Home Office receive your application. So you should be eligible from 21/06/2014.

Ok one last question.

We have had 2 visits to Spain 10 days each and a 2 short visits to Ukraine. since 21/06/2011.

Should I add on all the days of absence from UK onto the time before applying or do these short visits not count?

There are limited allowances for absences during the residential qualifying period for naturalisation.

If you read the application form, you should be able to work out in 10 seconds what needs to be done.
