Minimum Salary Clarification

Hi All,
I am a new member with an issue that is beginning to give me sleepless nights. I am on a TIER 1 PSW Visa and my company have applied and now gotten the sponsorship license because of me. However I looked at the code of practice and i qualify as a new entrant but on looking at the salary for new entrant for my category, my current salary is not up to it. My salary is based on a 37.5 hour week and the salary of the Code of Practice is based on 39 hour week. Prorating it, my salary falls short by about 1 pound per day. My boss believes that the salary stated may just be a guide and if I apply, I may get my Visa (my salary is above 22,000 pounds per annum) but she has asked me to clarify with HR.

I am not sure of this and even more worried as I have just 2 months left on my Visa and no time for mistakes. Has anybody faced this? Can anybody provide guidance? I don't know what to do.

Your boss is wrong, the salary in the document is clearly stated as being the minimum. Print out and give him pages 3-4:

If you apply with a lower salary (prorated for the hours you work) your application will be refused
