28 days rule

Is the 28 days rule includes both date of ILR application and current visa expiry date?

My Tier-1 visa is valid until 15/01/2014 and I'm thinking of applying on 19/12/2013 for ILR. So it comes out to be 28 days with both dates included. Am I safe to proceed?

This confuses more than answering anything. 5th year anniversary is ambiguous keeping in view below two points from UKBA. So, simple question again - does the 28 days counting to include date of application and last day of current visa?

Question: I received my grant of leave but delayed my entry to the UK by two months, have I broken the 5 year continuous period for ILR?
Answer: No. Provided the delay was no longer than 90 days, we will count the time between you being granted entry clearance and coming to the UK towards the continuous period for ILR.

Question: If I delayed my entry to the UK by less than 90 days, can I still apply at a PEO 28 days before my leave expires?
Answer: Yes you can still make your application at a PEO 28 days before your current leave expires

As per the dates you mentioned in your first post you should be fine. Moreover, you answered your both questions correctly too.
