Newborn Tier1 dependent visa or PR

Post by kuldeep » Sun Nov 24, 2013 11:27 pm

Hi All,
I got Tier1 on 9Nov 2010 from India & I had entered in UK in 5Feb 2011. In Nov 2012, I got extension for next 3years(till 8Nov 2015). I had visited india only once in Nov 2011 for 15days. As per UK rules my PR is due in Nov 2015.

My baby born on 1 May 2013 in UK & on 21st Nov i had applied for baby's birth registration in indian embassy. I will apply for passport after getting birth registration from indian embassy in Dec.

As per UK rules, my baby will get British citizenship after we got PR.

My questions
Q1. I am not planning to visit India soon but if I visit India with baby after getting his indian passport & then i will do the visa formalities in india. Does it will impact on my baby's British Passport?
Q2. If my baby will not go to India for next 2 years & i will not apply for baby's visa from here now and will wait for my PR till Nov 2015. Is he directly eligible for British Passport in Nov 2015 or he will get PR first or do i have to apply for visa first.

q1 -- no, will not have any impact
q2 - yes, he will be directly eligible, no ILR for the baby. just get ILR for yourself, and then register baby as UK citizen
