- proof of your employment in Germany (payslips for example)
- proof of residence for her
- marriage certificate
- both passports

- I would say in the cover letter that you as a British citizen has exercised your treaty rights in Getmany for X years living together with your wife for X years and you wish now to return to the UK.

It will be fine. Why did you apply so early if you are only thinking about going back in May 2014? What 'date of entry' did you write on the application form?

Just apply for the residence card (EEA2) when you are back in the UK.

Don't forget you will be asked to present your German payslips (or other proof of your employment) when your wife is applying for EEA2. You must make sure you have these handy (even if they were submitted when you applied for the EEA FP, you must be able to provide them again!)....this might take some work. Also, you will need to prove that you were living together (contract etc)

Hi chaoclive

I have applied early because of the new rule change on 01 14,and i have put the date on 07.02.2014 but they have issue my wife visa on 13.12.2013-13.06.2014.

and as i am living in germany i must let my landlord 3 month now.
before we travel we must sort some things out.
i don't have problem with payslip and work contract i have all that.

thanks again

The main purpose of the EEA Family Permit is to allow entry to the UK. Your wife could apply for the 5 years RC anytime you wish. The same day you land or several moths down the line (even after the FP expired). Under EEA Regulations there is no legal requirement to hold a valid "visa" as rights are obtained automatically. It is advisable to apply for RC to make it easier to prove those rights (to employers for example).

Whether you choose to use the form or not is up to you. There is no requirement to use it. If you choose to do so, I would print the whole form in case someone thinks you've missed pages and returns it to you.
