Hi thanks for reply in advance we are in uk after exersing eu treaty in italy we came through ireland my husband had family member of eu citizen visa .we travel from ireland to uk there was no immigration control on ferry i am british citizen and my husband non eu now with out eea famiy permit can we apply eea 2 residence card using surinder singh rout as my husband dont hAve legal entry .or is it going to cause problem .is legal entry requirement for singh route

Any advice as we are going to submit application on monday and after metock case in my opinion legal entry should not not be issue will apprecite reply

Legal entry is not a requirement under the EEA regulations, go ahead with submission.

You are not considered to have entered into the UK illegally if you entered the UK from Ireland according to this document from the UKBA
