When to apply for nationalisation.

Guy please your advise is need here!!!! i first came to UK to visit my wife in 06/2007, let after a month and came again in 11/2007. In 12/2007 me and my wife went to marry in budapest after the marriage, we both returned together in 09/2008 and ever since then both of us are living and working in UK.

I was recently granted my PR on the 30/10/2013. Please i will like to know when is the right time for me apply for nationalisation. Also had anyone applied successfuly without waiting for 12 months after PR. I heard there are disceration to disregard immigration time restriction. Please can someone explain to me about these disceration that involved proofing the link to UK through family and business.

Your responses are need to avoid mistake. thanks

Hi,
So if you've been granted PR then you've been on the EEA route. I'm also assuming that by 'granted my PR' you mean that you got your PR vignette/sticker (EEA3/4). EEA route applicants can apply for naturalisation if they can prove a minimum of 5 years of continuous treaty rights (PR) + 12 months free of immigration control. Based on this, you would be eligible certainly in Oct 2014 and possibly in Sept 2014, depending upon when your continuous period of treaty rights evidence started. Please note that although you can apply as soon as you meet the above requirements (even without your PR vignette), your naturalisation application will be a much simpler affair if you wait until your PR vignette is a full 12 months old. The difference is that if you apply earlier than that you will need to resubmit all of your treaty rights evidence that you submitted for your PR confirmation application, whereas after the PR vignette is 12 months old then that with your passport is sufficient evidence on its own.

I'm not aware of any discretionary circumstances for avoiding the above residential requirements. [anyone else have different information?] There is discretion that may be exercised if you have spent a larger amount of days outside the UK than the prescribed threshold during the relevant period, but that is a different matter.
