Naturalisation and PBS dependent

Post by lokmanick » Sat Jan 04, 2014 11:00 am

Hi,

What would happen to the dependent who is on PBS dependent VISA and main applicant move from ILR to British passport???
Will the PBS dependent visa be still valid or should the main applicant wait till the PBS dependent moves to ILR??
What is the cost effective way??

Thanks

No affect if the partner was granted ILR as a PBS applicant.

That has nothing to do with how the person qualified for ILR, does it?

My doubt is when the main applicant moved to British passport, he would be out of ILR. And will the PBS dependent visa be still be valid as main applicant will no longer have any UK visa, how can a dependent visa be valid when there is no main applicant visa?? Or will the PBS dependent visa be still valid???

Hope my question is clear...

But s(he) would still have gained ILR as a PBS applicant even if ILR does cease to exist upon acquiring British citizenship.

The rules specifically states:
319(C)(b) wrote:(iv) has become a British Citizen where prior to that they held indefinite leave to Remain as a Relevant Points Based System Migrant and where the applicant is applying for further leave to remain and was last granted leave:

Hi Amber,

I got my ILR last year 02/2013 and I am eligible to apply for British passport from 02/2014.
But my wife got her Tier-1 dependent visa on 06/2012, so she would be eligible for ILR only from 06/2014.
My question is can I get British passport before she getting ILR ie by Feb 2014??? Can she still hold the PBS dependent visa when i get Citizenship??
I am from India and I cannot have dual citizenship.

Thanks
