PR help Please

I want to know after getting my retention rights. next year my RC will expire when I'll apply for PR.
Can i still apply using my ex-wife documents as EU family member?
Or I would Apply using only my own documents to get PR?

I'm divorce now with my wife but we're still good friend.

I just was confused because I saw some posts here where people are divorced are still applying for PR with documents of ex-wife as family member of EU citizens.

You need to show 5 years exercise treaty right for PR

- Your exercise treaty right 5 years after divorce

Or

- Your Ex wife treaty right + yours after divorce; example : 3yrs+2yrs or 4yrs+1yr
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021

Does he need to send his ex-wife's documents (eg. passport) to support his PR application?
Or,
Just declaring divorced and evidence of exercising treaty rights for 5 years would be enough?

Do I need to send my ex-wife documents(eg. Passport or EU ID card or PR card)?

At the best of my knowledge: if you have retain your right after divorce, then for PR you will need document showing your wife exercise treaty right during the years of marriage until the divorce was finalised + proof of cohabitation + your psilp or contract showing you exercise treaty right after divorce. According to the link you will not need your wife passport.

Passport or ID is a requirement according to the UKBA. There several cases where application refused by UKBA

check Page 27 in the application form " Your EEA national family member’s current passport or ID Card. If they do not have a passport or ID card, you must provide another form of identity"

But still you/lawyer can argue the case or appeal because Home office already seen the passport when you send EEA2 application but if you never applied for EEA2 before then obviously application will be rejected straightway

you mean after divorce with ex in 3 years and applying for ROR to retain ( EEA2 ) right, ex wife passport is very important? I have read so many story in this forum were guys did not submit ex passport or Id to HO, please help me with this as i am not applying for PR but have already submited ROR for EEA2

You do not need her passport. Only proof that she exercised her treaty rights during your marriage and at the day when your divorce was finalized (decree absolute issued). After that day you need to prove that you were working yourself. Your marriage should last no less than 3 years. You may apply for PR after 5 years since you married. Good luck!
