ILR application query - 6.3 question Set O form

ILR application query - 6.3 question Set O form

Hi All,

I have a query regarding absences (Page 14 - 6.3 of the SET O Form).
I came to UK on 30-Aug-2008 on Work permit. I have switched to Tier1(General) migrant on 01-May-2009. I was seconded by UK company at that time. I have left UK on 29-Oct-2009 and came back 30-Jun-2010(244 days out side of UK). During this period I was in Indian payroll and I don't have any proofs from the UK employer for these absence.

As per this document (http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary)
if my ILR application date is 08/02/2014 then all my absences were less than <180 days.

Year 1 08/02/2014 09/02/2013 0
Year 2 08/02/2013 09/02/2012 17
Year 3 08/02/2012 09/02/2011 9
Year 4 08/02/2011 09/02/2010 141
Year 5 08/02/2010 09/02/2009 110

Still , do I need to show any proofs ?Could you please suggest what other proofs I can submit? or which option I need to select in 6.3?

Hi, hope you find some way. But one thing that becomes glaring is that you seem to have been away for more than 180 days at a stretch. Even though when you are splitting under different years, it comes within 180. I would imagine the original idea for 180 days must be that - someone goes away, comes back, goes away, comes back, but at one stretch it is not more than 180 days.

But then I am speculating here, I could be wrong. Good luck.

Hi again, I just saw the below post. So looks like the rule is "During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months."

We have only this rule
In UK BA it states that "During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months."
I have not seen any limit for entire 5 years. Not sure if any exists.

I am also in the same situation as you more worse than actually. I was away for 163d without work in uk in one of the year...

When you are planning to apply? Have u met any solicitor for this?"
